PayPal's Unfair Play: Court Ruling Shocks Small Merchants
PayPal Australia just got a reality check from the federal court, which ruled that a sneaky contract term in their small business agreements was downright unfair.
The controversial clause allowed PayPal to keep fees they mistakenly charged unless the small business flagged the error within 60 days.
The gavel came down after the Australian Securities and Investments Commission (ASIC) launched legal action against PayPal in September 2023.
ASIC argued the term was a bum deal for small merchants, who had to sift through complex statements to find these errors - a task easier said than done.
The court agreed, pointing out how this put small businesses in a tough spot, unlike PayPal, who could have easily sorted it out themselves.
Bowing to the pressure, PayPal admitted the term was unfair and axed it from their contracts as of November 8, 2023.
ASIC’s Deputy Chair Sarah Court made it clear: companies better ditch any unfair clauses or face the music.
She emphasized that ASIC is ready to step up for consumers and small businesses whenever needed.
The court also demanded PayPal cover ASIC's legal costs, showing the watchdog means business.
